How to use it

Three steps to activate your rights.

01

Identify the right template · 5 minutes

Depending on your situation (delay, refusal to lift, silence, Breyne Law), choose the suitable variant. Read the notice carefully: the formal notice is only effective if legally founded and precise. A poorly drafted formal notice can be deemed null by the court and cost you valuable weeks.

02

Personalise and send by registered mail

Open the Word file, fill in: your full identity, the contractor's identity (company name, CBE, registered office address), contractual references (contract number, date), precise description of the breach with dates and facts, amount claimed (penalties, retention guarantee, damages), period granted for compliance (typically 15 working days). Print two copies, sign, send by registered mail with acknowledgement of receipt.

03

Follow-up at 15 days and next step

On D+15, two scenarios: (a) the contractor complies — keep the written evidence of the resolution; (b) he does not comply or reply — you can then refer the matter to the summary judge (urgent procedure within 30 to 60 days) or to the justice of the peace (disputes < 5,000 €) depending on the case. The unanswered formal notice is the key piece of your file before the court.
